I disagree she was probably pissed that he was challenging her authority and decided to instead go out and bust some more "scooter trash".

Dan I am glad you won but I understand your feeling about the judge. In my hometown we have a judge on the bench that is the same way. Guilty until proven guilty is her motto I think. I don't know anyone that has gone up for something like that and gotten off unless there were MULTIPLE witnesses to backup the evidence. Everytime it was one person's word versus the officer the judge ruled for the officer.

That is probably why I have an issue with the court system. I think there should be some consequence for the officers not showing up though. If I don't show they can arrest me. I understand that if they don't show my case is thrown out and I win but showing up is part of their job. Can any LEOs explain that for me?

In Utah it seemed that you'd get a 50/50 chance of the officer not showing up. I asked an approachable (not scowling like he hates the world) Denver cop and asked them what the chances of a cop missing a court date for a traffic ticket was. He said very slim. He said that they get some kind of negative demerit on their record if they miss court, so they'll always be there.

All the cops for all the other cases were there, mine was the only one not there. Perhaps she knew that she was not at her best and that it was filmed, and decided not to make it all part of a public record, and it was worth taking the demerit for. Or perhaps not, I don't know? I thought that with an 8:30 court time, she'd be there for sure. Later in the day it would seem that she'd maybe be busy on something important and not be able to leave, but first thing in the morning seemed like a bad court time for having a cop too busy to come.

In Denver, in the three years we've been here, I've had a photo ticket get lost on the courts end (I didn't offer them my copy :) ) and get dismissed. My wife had a speeding way too fast in a school zone (neither of us knew it was in a school zone, in Utah they have flashing lights, here they don't, wasn't expecting it) lost on their end and dismissed. Now I've had a cop miss court, and it get dismissed.

Moral of the story is, don't pay, set it for trial. All three tickets would have been paid and on our records if we just sent the money in like usual. And even if it doesn't get lost, and the cop shows up, it becomes a fun civic lesson.

How about this? obtain a half helmet with an eye shield that comes down about two inches from teh top/front of the helmet and it will just cover your eyes..then contrast this with the full face visor pulled up a little as in your photo....might make her look irrational, as obviously the full helmet with the face shield nearly down is much more protective than the narrow shield on a half helmet....besides the statute that was quoted said the helmet must "contain" an eye shield..

After all that build up what a letdown. I would have expected Hamilton Berger to demand the officer show up for such a high profile case.

Civic lesson is absolutely right. But it definitely has never been the lesson I was taught in school, blind justice and all that inocent until proven guilty junk.
