Dan Lund and some others had a discussion about handling tickets awhile back.

I did what they call a "Trial by Written Declaration" here in California, and was found guilty. I then requested a court trial, which you have a right.

I went to court this morning. The Highway Patrolman called in saying he would not be there, and did not want a continuance. The DA said he did not either, and the case was dismissed.

$161.00 refund coming and more importantly because I have some left over from my MC wreck, no additonal points on the driving record.

As I believe Dan said, plead not guilty and if there's a no-show by your accuser, you'll be free at last!

Now, back to those 85MPH cruises :)

I shoulda, but it was a sheriff's deputy in a small community and figured he'd show for sure. And there are those extra court costs, plus they got a scam going where your points are cut in half if you pay up quickly. 85mph cruises will have to wait.

Which reminds me, we haven't heard much from our law-enforcement contingent lately, although I know some ride with the Blue Knights. DUI5xx are you out there?

Yeah, good shout out for DUI. I don't ever want to sound disrespectful of those that serve us, because I'm not, but you need to look out for yourself.

I honestly believe there was an error in judgment on the part of the officer, and I think he considered it a possibility too, and decided to not show. He did call and say he wouldn't be there. I respect him for that because I didn't deserve the ticket. It really is that simple.

Everyone's happy now (I hope)

My lawyer told me he didn't care if I stoled a church and the steeple was sticking out my ass, plead not guilty

Juan, congratulations. Maybe you're right about the officer's reason for a no-show.

One question I've always had. When I write someone a ticket and they pay without going to court, why do they pay the same court costs as those who make an appearance?

First, I'd like to clarify myself, and I'm sorry that I mislead some. My ticket was not for speeding. I was cited for passing cars, utilizing the emergency lane, which has been resolved.

There are additional fees for us that fight the ticket too. Time to gather your defense in a cohesive manner, time from work without pay to attend the court proceedings, fuel to get there, Standing in line to buy a parking pass, the parking fees, and not to mention the stress of watching each Officer walk through the door, hoping it ain't your man. Then the stress of the oncoming fight in court, which is a foreign battle ground to the average guy. In the end, it's much easier to pay the fine, even with some fee you speak of. Besides, we have a right to confront and defend against those that accuse us, in a civil manner, and if we didn't,,, well, you know.

Not withstanding, I thank you for being there for us, and protecting us. I'm thankful for our law enforcement folks, and everyone who risks their stuff everyday here and abroad.... Peace to all...

Good for you Ron...My youngest son received a letter in the mail a couple of months ago from the St. Charles Parish Sheriff's Office. It stated that he was clocked doing 38 in a 25 mph school zone. No ticket in the envelope and no picture. Just a letter with the cost of the fine and also that if he paid it right away it would go into Article 894 which is a 6 month probation. No more tickets in 6 months and it won't be on his record. I think he could have fought this and won. He paid the $184 fine because he was afraid he would lose the case and have to pay additional court costs and the ticket would be on his driving record. I would have taken a day of vacation and went to court but that's just my opinion.
