Dan Lund and some others had a discussion about handling tickets awhile back.
I did what they call a "Trial by Written Declaration" here in California, and was found guilty. I then requested a court trial, which you have a right. I went to court this morning. The Highway Patrolman called in saying he would not be there, and did not want a continuance. The DA said he did not either, and the case was dismissed. $161.00 refund coming and more importantly because I have some left over from my MC wreck, no additonal points on the driving record. As I believe Dan said, plead not guilty and if there's a no-show by your accuser, you'll be free at last! Now, back to those 85MPH cruises :) Login or Register to Remove Ads |

I shoulda, but it was a sheriff's deputy in a small community and figured he'd show for sure. And there are those extra court costs, plus they got a scam going where your points are cut in half if you pay up quickly. 85mph cruises will have to wait.
Which reminds me, we haven't heard much from our law-enforcement contingent lately, although I know some ride with the Blue Knights. DUI5xx are you out there? |

Yeah, good shout out for DUI. I don't ever want to sound disrespectful of those that serve us, because I'm not, but you need to look out for yourself.
I honestly believe there was an error in judgment on the part of the officer, and I think he considered it a possibility too, and decided to not show. He did call and say he wouldn't be there. Back when I was a young hot shot I used to get a few tickets for speeding. My lawyer told me he didn't care if I stoled a church and the steeple was sticking out my ass, plead not guilty

Juan, congratulations. Maybe you're right about the officer's reason for a no-show.
One question I've always had. When I write someone a ticket and they pay without going to court, why do they pay the same court costs as those who make an appearance? |

Good for you Ron...My youngest son received a letter in the mail a couple of months ago from the St. Charles Parish Sheriff's Office. It stated that he was clocked doing 38 in a 25 mph school zone. No ticket in the envelope and no picture. Just a letter with the cost of the fine and also that if he paid it right away it would go into Article 894 which is a 6 month probation. No more tickets in 6 months and it won't be on his record. I think he could have fought this and won. He paid the $184 fine because he was afraid he would lose the case and have to pay additional court costs and the ticket would be on his driving record. I would have taken a day of vacation and went to court but that's just my opinion.
