Five Years In Jail For Recording An Officer!
HOLY COW! I live in Maryland, and as most of you already know, I take pictures and record from my motorcycle ALL THE TIME!!!! I had NO CLUE they could do this to you!!!!!!!

Sounds pretty anal to me of the police department. For me, if someone pulled a gun on me in an unmarked car and no uniform without identifying themselves as police, they might have been run over.
Here's to hoping that he gets off and the police get a stiff reprimand for their actions.

The cop should be fired for the way he stopped him, thats not neccessary for a traffic stop, and now they are trying to hang the biker with some more bogus crap.

You have to be kidding me. They would be charging me for more than recording a trooper with out his permission. Cut me off gt out of your car with weapon drawn telling me to get off the bike while advancing towards me. I have the god given right to protect myself and would have in that situation. he didnt identify himself as a peace officer for almost 5 seconds. he is very lucky this didnt turn into something very very bad for everyone involved or nearby. :(" title="" border="0"/>

You have to wonder why the marked car didn't pull him over It just leaves you to believe the unmarked cop was out of line , he could have backed up the cop in uniform and their would be no problem.

He needs a good attorney. State Police off duty, at least in California, do not have jurisdiction for non-felony traffic enforcement. they are only allowed to draw down on felony crime in progress situations. I'd sue the p*ss out of them and make an example of the Barney Fife Yahoo.

In our local riding group, we have a rider that is a Capitol Hill police officer (Washington, DC). This is how he defends the actions of the police force for this incident, which I STILL don't agree with...to quote him:
The law is not just for this it goes back to the same law that requires police to have a warrant for a wiretap. If this had been 2 citizens the charge would be the same. It is to protect anyone from being recorded without their knowing it and consenting to it. If you ever look at police videos in Md it is just video no audio because the same thing applies. The last case I know of was an employee recording his boss when being fired and not only did he lose his job but when he presented the recording at his unemployement hearing he was denied unemployment but ended up with a place to stay and a job courtesy of the state prison system.

I think he can beat this with a decent attorney. The plain clothed trooper was wrong for not properly identifying himself when he exited his car. I'd bet the State Attorney withdraws the charges before it goes to court.

The State got there panties in a wad because he put it on U-Tube and they are going to make and example of him. I agree the marked car should have put the lights and siren on the guy and the plains clothes officer should have done back up. What really got me was that he was not arrested but his computers and equipment was confiscated. Even if he gets the charges dropped he will be lucky to get the computers and equipment back undamaged, and most likely all of his files will be deleated and the hard drive wiped clean.

That is incredulous to me, I use a helmet cam as well. I would be really curious to see what the marked cars dash cam shows tho, because you don't really know how he edited that tape. Not to back either side but who is to say that that is not the 2nd time they got the guy stopped and the plainclothes was blocking him. Just saying that it would be nice to see the other camera's tape to get a 2nd point of view
