No duty to retreat
This is way off topic. It's about something I heard on the radio on my way home today.
8 weeks ago, two teenage brothers were standing along the cul-de-sac they live in in Mesa. Another teen drives by in a car and throws a water bottle at them, and then drives a few more feet and stops. The brothers had no clue why someone was throwing stuff at them, so they approached the car to ask why. They got within a few feet of the car and without saying a word the driver pulls a pistol and shoots at them. One of the brothers is killed. 8 weeks later, the shooter hasn't been arrested, he claims he "felt threatened" and feared for his safety. AZ has a "no duty to retreat" law which says if a person is in a place he may lawfully be and is threatened, he has no duty to retreat to avoid a confrontation. This story really bothers me, for several reasons. 1. As I was taught in my CCW class concerning the use of deadly force, you can't pick a fight and finish it with a gun. That's not acting in self defense if you started it. 2. It sounds to me like the driver was trolling for victims by acting in such a way to provoke a confrontation just to shoot somebody. 3. When the brothers saw the gun, they were retreating as they were shot. The boy who was fatally wounded was shot in the side as he was turning to run to avoid being shot. In my opinion, the city attorney should be fired for incompetence for failing to prosecute the shooter. It's possible the hosts on the radio show didn't have all the facts, but it seems like capital murder to me.

Sounds a lot like the shooting if Florida this week that made national news. Kid was running from a self appointed 'security guard' who claims he felt threatened. Kid was unarmed. I think the shooter needs to go to trial to determine guilt or innocence.

Sounds extremely bizzare as to why they were not arrested. If they felt threatened why did they not drive off. They were in the car and they started it.

Kinda the same deal in Florida.
Black 17 year old leaves his gated community to go to a convenience store for some skittles and a soda. He is wearing a hoodie. As he is returning the neighborhood watch captain sees him and thinks he is acting suspicious. He calls 911 and says he is following him because he looks suspicious. 911 operator say we do not recommend you follow him. BANG, a shot is heard on the tape. He kills the kid. This was a week ago. No arrest as the guy said he shot the kid in self defense. You guys must have read this, it is all over the news. I have to wonder what the political stance on guns is of the city attorney. This could be used in the future as a way to show "how bad our gun laws are". Even though it is not that the laws are bad, it is how they are enforced and inturpreted that is bad.

Actually Bud, the youth in Florida was shot February 26. It has only been in the past week or so the story has made the national news.

Doesnt matter, the media and public already have him guilty...saw Sharpton giving his lynch him speech on the situation..... irrelevant of any trial...they already know he's guilty, and if he gets to trial and found not guilty... Remember Rodney King verdict and the reaction? ..... I do.

According to Tampa Bay Fox affiliate WTVT-TV, what the witness says he saw could bolster Zimmerman’s claim that he shot Martin in self-defense: “The guy on the bottom who had a red sweater on was yelling to me: ‘help, help…and I told him to stop and I was calling 911,” he said. Trayvon Martin was in a hoodie; Zimmerman was in red. The witness only wanted to be identified as “John,” and didn’t not want to be shown on camera. His statements to police were instrumental, because police backed up Zimmerman’s claims, saying those screams on the 911 call are those of Zimmerman. “When I got upstairs and looked down, the guy who was on top beating up the other guy, was the one laying in the grass, and I believe he was dead at that point,” John said.
